Tourism Western Australia LADbible Australia Promotion


  1. The Promoter is the WESTERN AUSTRALIAN TOURISM COMMISSION a body corporate under the Western Australian Tourism Commission Act 1983 (WA) of 1 William Street, Perth, Western Australia, 6000, ABN 95 468 665 668 (“Promoter”).
  2. A reference to the Promoter includes its officers, employees, agents and contractors.
  3. The Promoter is running the Tourism Western Australia LADbible Australia Promotion (“Promotion”). The Promotion exists to create awareness of a working holiday in Western Australia amongst potential working holiday makers in Australia. People can enter by completing the entry form on the competition landing page: https://www.westernaustralia.com/en/pages/follow-the-sun-au.  The Promotion is a game of skill to win one (1) of ten (10) one-way Virgin Australia flights to Perth, Western Australia prize certificates.
  4. Entry is open to people who are at least 18 years of age, currently residing in Australia (outside of Western Australia) and a holder of a valid Working Holiday visa (Class TZ) (subclass 417) issued by the Australian Government, Department of Home Affairs. (“Entrant”).
  5. By submitting an entry to this Promotion, the Entrant is deemed to accept these Terms and Conditions.
  6. Officers and employees of the Promoter and the Promoter’s contractors and agents associated with this Promotion and their immediate family are not eligible to enter.  For the purpose of this clause 'immediate family' means 'spouse, de-facto, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin'.
  7. The Promotion commences at 05:00 am Australian Western Standard Time (AWST) on 8 March 2023 and closes at 8:00 pm (AWST) on 4 June 2023 (“Promotional Period”).
  8. To enter, entrants must, during the Promotional Period complete the competition entry form at https://www.westernaustralia.com/en/pages/follow-the-sun-au.  Entrants must provide an answer to the following questions:
    • What is your dream tourism or hospitality job in Western Australia?”
    • “Which of our five regions is this job located in?”; and
    • In 25 words or less, tell us why this job is calling your name!
  9. Only one (1) entry per entrant is permitted.
  10. The Promoter will select the ten (10) most creative answers with the ten (10) winners to be identified at 10:00 am (AWST) by 8 June 2023 at the offices of the Promoter and will be notified by telephone and email by close of business 9 June 2023 (AWST).
  11. The Promoter will attempt to contact the winners on 9 June 2023 by telephone, and for a period of up to five (5) days following this date, by phone and email.  The winners must claim their prize within that period or the Prize will be forfeited and another winner selected, if applicable, on 19 June 2023.
  12. Each winner will receive a one-way economy class flight with Virgin Australia to Perth from any Australia State capital city (some flights may not be a direct flight route to Perth). (Prize or Prize Certificate).
  13. The following terms and conditions apply for each Prize Certificate, as per Virgin Australia's terms and conditions:
    • The Prize Certificates expire twelve (12) months from the date of the prize draw: Friday 9 June 2023.
    • Both the Prize Certificate and flights are non-redeemable for cash.
    • Tickets redeemed under this Prize Certificate are valid on Virgin Australia-operated flights only and not code-share services.
    • Tickets are non-transferable (i.e. no name changes allowed after ticketing).
    • Tickets are for one (1) passenger travelling on the same booking.
    • Tickets redeemed under this Prize Certificate are subject to the following Fare Class availability: Economy– Booking class Blackout periods; 24JUN22 to 17JUL22 16SEP22 to 01OCT22 17DEC22 to 02JAN23 06APR23 to 24APR23 23JUN23 to 15JUL23 15SEP23 to 06OCT23 17DEC23 to 11JAN24
    • All bookings need to be made at least seven (7) days prior to travel.
    • Bookings can be requested via email at prize.winners@virginaustralia.com, Monday - Friday between 09.00 - 17.00 (AEST).
    • Any changes to bookings once ticketed will incur a $50 change fee per guest, per change and any change is subject to availability.
    • Virgin Australia’s terms and conditions of carriage apply to the Ticket. Virgin Australia’s terms and conditions of carriage are online available at http://www.virginaustralia.com/au/en/about-us/legal-policies/conditions-of-carriage/.
    • Passengers who do not notify Virgin Australia at least 24 hours prior to scheduled departure that they are unable to take the booked flight will forfeit the Ticket.
    • Prize Certificates or Tickets may not be sold or offered for resale at a premium (including via online auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services, either by the original recipient or any subsequent bearer. If a Prize Certificate or Ticket is sold or used in breach of this condition, it will be cancelled at Virgin Australia’s sole discretion.
    • Tickets cannot be upgraded and are not valid to earn Velocity points or status credits.
    • It is your responsibility to ensure that you and your travel companion (if any) have the requisite visas, vaccinations, valid documentation (including but not limited to valid passports and visas) which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility.
    • You are responsible for all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurrent in the event of unforeseen circumstances.
  14. The Prizes are exclusive of any additional costs and liabilities incurred beyond the value of the Prize (used in accordance with the conditions of use) or incurred after the Prizes have been redeemed.
  15. Individual terms and conditions may apply for some parts of the Prizes and the Prize winners should refer to these on receipt of the Prize.
  16. If any part of the prize is unavailable, the Promoter, at its sole discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any law or written directions from a regulatory authority.
  17. The Prize is personal, non-refundable and non-transferable, exchangeable, or redeemable for cash.
  18. The Promoter reserves the right to verify by any means which the Promoter considers necessary the identity of any entrant and to satisfy itself that the entrant has fulfilled these Terms and Conditions. The Entrant must cooperate fully with the Promoter in any verification process. To redeem their prize, winners will need to verify that they:
    •  currently reside in Australia (outside of Western Australia) by providing proof of address; and
    • must confirm that they are eligible to work in Australia by providing the Promoter with a copy of a valid Working Holiday visa (ClassTZ) (subclass 417) issued by the Australian Government Department of Home Affairs.
  19. If an Entrant breaches any of these Terms and Conditions, acts unlawfully, tampers or attempts to tamper with the Promotion, jeopardises the fair and proper conduct of the Promotion, or acts improperly or unethically (each in the Promoter's sole opinion), the Promoter reserves the right to disqualify the entry and any prize will be forfeited.
  20. The Promoter's decision is final and binding. No correspondence will be entered into. No Entrant shall have, bring or assert any legal or equitable right under or in connection with the Promotion or these Terms and Conditions, including anything done, attempted, not done or not attempted by the Promoter under or in connection therewith. In that regard, neither the Promotion, nor these Terms and Conditions, nor anything done, attempted, not done or not attempted by the Promoter under or in connection therewith shall be justiciable. The preceding provisions of this clause 20 apply even if the Promoter, through its negligence, has caused the Entrant any sort of loss.
  21. The Promoter may suspend, vary or cancel the Promotion at any time.
  22. If the Promotion is being conducted electronically:
      • the time of entry will in each case be the time the online entry is received by the Promoter’s database. The Promoter accepts no liability, in negligence or howsoever, for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason;
      • any costs associated with accessing the promotional website or downloading the entry application are the entrant’s responsibility and may depend on the entrant’s usage plan; and
      • the entrant must not submit an entry which includes any computer virus or other harmful computer software.
  23. The Promoter reserves the right to contact any entrant in connection with future promotions.  If an entrant does not want this to occur, the entrant may in accordance with the Promoter’s Privacy Policy, unsubscribe from the mailing list at the time of receiving promotional material.
  24. All entries become the property of the Promoter.
  25. If the Promotion involves an entrant submitting the entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same), the Promoter may use any of these for any purpose in any media for an unlimited period of time without payment.
  26. If the Promotion involves the entrant submitting anything in writing, the entrant grants to the Promoter the copyright to it and warrants to the Promoter that it is the entrant's original work.
  27. The Promoter collects personal information in order to conduct the Promotion and may disclose such information to third parties and partners (email and first name only), including, but not limited to, the Australian Hotels Association of Western Australia (AHAWA) who manages westernaustralia.jobs, for future promotional, marketing and publicity purposes.  Entrants should direct any written request to access, update or correct personal information to the Promoter.
  28. To the fullest extent permitted at law all implied terms and conditions are excluded from these Terms and Conditions.
  29.          To the fullest extent permitted at law, each entrant releases the Promoter from any and all liability (in contract, equity, negligence, or howsoever) for costs, damages, expenses, and losses which any entrant may suffer or incur as a result of the Promoter's action or inaction arising out of or in connection with the Promotion or these Terms and Conditions. The entrant agrees not to bring or assert any claim, proceeding or cause of action against the Promoter, accordingly. The entrant shall indemnify the Promoter from any and all losses, costs and expenses sustained by the Promoter on account of the entrant breaching this clause 26 or any other provision of these Terms and Conditions.
  30. Without limiting clause 28 in no circumstances is the Promoter liable to any entrant for any indirect or consequential losses, including but not limited to loss of opportunity (including business opportunity), revenue or profit.
  31. Without limiting clauses 28 and 29, the Promoter is not liable (in negligence or howsoever) to the entrant for the acts or omissions of third parties (including any parties for whom the Promoter is or may be vicariously liable).
  32. These Terms and Conditions are governed by the laws of Western Australia irrespective of the place of residence of any entrant.
  33. In these Terms and Conditions, unless the context otherwise requires –

entrant or Entrant means someone who participates by submitting an Entry to the Promotion.

Entry means the submission of a validly completed entry form during the Promotional Period.

Promoter means the Western Australian Tourism Commission a body corporate under the Western Australian Tourism Commission Act 1983 (WA) of 1 William Street, Perth, Western Australia, 6000, ABN 95 468 665 668.
