1. The Promoter is TOURISM COUNCIL WESTERN AUSTRALIA LTD of 1 Resort Drive, Burswood, Western Australia 6100, ABN 69 095 581 776 (Promoter).
  2. A reference to the Promoter includes its officers, employees, agents and contractors.
  3. The Promoter is running the 2026 7NEWS Top Tourism Town Awards consumer voting campaign, which is a game of chance to win one of two travel vouchers to explore Western Australia (“Promotion”).
  4. The voting campaign will be hosted on the Western Australian Tourism Commission trading as Tourism Western Australia (Tourism WA) owned website https://www.westernaustralia.com.
  5. By submitting an entry to this Promotion the entrant is deemed to accept these Terms and Conditions.
  6. Entry is open to individuals who are 18 years of age or over that reside within and outside of Australia.  
  7. Officers, employees, contractors, agents and immediate family of the following are not eligible to enter the Promotion: a) the Promoter; b) Tourism WA; and c) Visitor Centres WA. For the purpose of this clause 'immediate family' means 'spouse, de-facto, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin'.
  8. The Promotion commences at 0900 Western Standard Time (WST) on Thursday 2 April 2026 and closes at 1700 (WST) on Friday 1 May 2026 (“Promotional Period”).
  9. To enter, entrants must, during the Promotional Period, select their favourite Western Australian city/towns from the published lists accessible on https://www.westernaustralia.com/en/pages/top-tourism-town-awards and complete a short entry form. Only one entry per email address is permitted.
  10. A Grand Prize Winner and Runner Up Prize Winner (“Winners”) will be selected at random, according to the Promoter.
  11. Two (2) Winners will be selected at random at 10:00 (WST) on Monday 4 May 2026 at the offices of Tourism Council Western Australia Ltd, 1 Resort Drive, Burswood, WA 6100.  The Winners will be notified by email on Monday 4 May 2026.
  12. The Promoter will attempt to contact the Winners on the date they were chosen, and for a period of up to four (4) business days following this date, by email.  The Winners must claim their prize within that period or the prize will be forfeited and another winner selected, if applicable before Friday 8 May 2026.
  13. The Grand Prize winner will receive a prize voucher from the Promoter consisting of a Western Australia travel voucher to the value of $5,000 AUD to be spent at the Western Australian Visitor Centre (https://www.wavisitorcentre.com.au). This voucher must be used within 12 months from the date of issue, can only be used for travel from and within Western Australia (including the Indian Ocean Territories) and cannot be repurposed or exchanged for money and is also subject to any terms and conditions imposed by the Western Australian Visitor Centre once bookings are confirmed and ticketed. Any ancillary costs including travel insurance associated with redeeming the prizes are not included. These are the responsibility of the Winner. If any part of the prize is unavailable, the Promoter, at its sole discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any law or written directions from a regulatory authority.
  14. The Runner Up Prize winner will receive a prize voucher from the Promoter consisting of an accommodation voucher to the value of $500 AUD to be spent at any RAC Park or Resort in Western Australia (link to https://parksandresorts.rac.com.au/). This prize is redeemable during low, mid-season only and subject to availability. Excludes school holidays and public holidays. Valid for cabins, villas, studios and dorms only, excludes unpowered, powered and ensuite camping sites. Cannot be used in conjunction with any other offer, discount or sale rate. Voucher can only be redeemed at the specified park/s within 12 months from the date of issue. Recipients stay must take place before this date. Redeemable on accommodation only, excludes food and beverage, activities and tours. The prize is not transferable, or redeemable for cash. Any ancillary costs including travel insurance associated with redeeming the prizes are not included. These are the responsibility of the Winner. If any part of the prize is unavailable, the Promoter, at its sole discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any law or written directions from a regulatory authority.
  15. Prizes are not exchangeable, redeemable or transferrable.
  16. The Promoter reserves the right to verify by any means which the Promoter considers necessary the identity of any entrant and to satisfy itself that the entrant has fulfilled these Terms and Conditions. The entrant must co-operate fully with the Promoter in any verification process.
  17. If an entrant breaches any of these Terms and Conditions, acts unlawfully, tampers or attempts to tamper with the Promotion, jeopardises the fair and proper conduct of the Promotion, or acts improperly or unethically (each in the Promoter's sole opinion), the Promoter reserves the right to disqualify the entry and any prize will be forfeited.
  18. The Promoter's decision is final and binding and at its absolute discretion.  No correspondence will be entered into.
  19. The Promoter may suspend, vary or cancel the Promotion at any time.
  20. If the Promotion is being conducted electronically:
      • the time of entry will in each case be the time the online entry is received by the Promoter’s database. The Promoter accepts no liability, in negligence or howsoever, for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason;
      • any costs associated with accessing the Promotional website or downloading the entry application are the entrant’s responsibility and may depend on the entrant’s usage plan; and
      • the entrant must not submit an entry which includes any computer virus or other harmful computer software.
  21. The Promoter reserves the right to contact any entrant in connection with future promotions.  If an entrant does not want this to occur, the entrant must notify the Promoter of that in writing.
  22. All entries become the property of the Promoter.
  23. If the Promotion involves an entrant submitting the entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same), the Promoter may use any of these for any purpose in any media for an unlimited period of time without payment.
  24. If the Promotion involves the entrant submitting anything in writing, the entrant grants to the Promoter the copyright to it and warrants to the Promoter that it is the entrant's original work.
  25. The entrant consents to the Promoter and Tourism WA collecting personal information in order to conduct the Promotion and may disclose such information to third parties, including, but not limited to, prize suppliers, and for future promotional, marketing and publicity purposes.  Entrants should direct any written request to access, update or correct personal information to the Promoter.
  26. By submitting an entry, the entrant consents to Tourism WA handling entrant’s personal information (e.g. first name, last name, address, suburb, state, postcode, phone number, email address, gender, date of birth) in accordance with their Privacy Policy which can be accessed at https://www.westernaustralia.com/en/pages/privacy-policy. Tourism WA’s Privacy Policy may be updated from time to time and it will be the entrant’s responsibility to keep up to date with any changes to the Privacy Policy.
  27. To the fullest extent permitted at law all implied terms and conditions are excluded from these Terms and Conditions.
  28. To the fullest extent permitted at law each entrant releases the Promoter and Tourism WA from any and all liability (in negligence or howsoever) for costs, damages, expenses, and losses which any entrant may suffer or incur as a result of the Promoter's or Tourism WA’s action or inaction arising out of or in connection with the Promotion.
  29. Without limiting clause 28 in no circumstances is the Promoter or Tourism WA liable to any entrant for any indirect or consequential losses, including but not limited to loss of opportunity (including business opportunity), revenue or profit.
  30. Without limiting clauses 28 and 29, the Promoter and Tourism WA is not liable (in negligence or howsoever) to the entrant for the acts or omissions of third parties (including any parties for whom the Promoter or Tourism WA is or may be vicariously liable).
  31. These Terms and Conditions are governed by the laws of Western Australia irrespective of the place of residence of any entrant.
  32. In these Terms and Conditions “entrant” or “Entrant” means someone who participates in the Promotion as a contestant.
